Brazil Investor Residence: Business and Property Routes Compared

Compare business investment, the conditional innovation exception and urban-property investment under separate Brazilian residence rules.

By Zachariah Zagol, OAB/SP 351.356 Updated:

Brazil has separate residence rules for investment in a Brazilian company and investment in urban property. The amount alone does not establish eligibility. An investor should identify the relevant resolution before transferring funds or signing an unconditional purchase agreement.

Which investment route applies?

RouteAmount to assessConditions that matter
Business investment: RN 13/2017, art. 2At least R$500,000Investment in a Brazilian legal entity, external funds and an investment or business plan
Innovation/research exception: RN 13/2017, art. 3At least R$150,000Qualifying innovation or scientific/technological research and one of the defined supporting situations; not a general small-business discount
Urban real estate: RN 36/2018R$1,000,000Qualifying urban property and documented external funds; separate property and immigration checks
North/Northeast property reductionReduction of up to 30%, giving R$700,000Geographic and other RN 36 conditions still apply

Sources: RN 13/2017, consolidated text and RN 36/2018, consolidated text. The corporate-executive route under RN 11/2017 has its own investment/job-creation criteria; those must not be imported into an individual-investor application.

What makes an innovation investment eligible?

The reduced amount is tied to the legal criteria and evidence of the qualifying venture. A technology-related CNAE code or describing a business as a startup does not establish eligibility by itself. Review the investment plan, the venture’s activities and evidence of one of the situations in art. 3, including relevant innovation support, technology-park/incubator status or accelerator backing.

Is a property deed enough?

No. The immigration file requires the investment and external origin of funds to be documented under RN 36, alongside the applicant’s other required records. Property due diligence must separately examine title, encumbrances, seller authority, contractual terms and restrictions. A purchase through a company is not automatically interchangeable with a personal property-investor application.

The route concerns urban property; there is no general requirement that it sit in a special development zone. Rural land has a different legal framework and must not be presented as an equivalent qualifying purchase.

Is residence immediately unconditional or permanent?

Do not assume that approval ends the investment conditions. Read the duration and conditions of the actual grant and the consolidated resolution. The property route provides an initial authorization of up to four years and conditions for changing to an indefinite term. Business-investor continuation also requires evidence concerning the investment/business plan. Do not sell, withdraw capital or close the business on the assumption that issuance of a residence card alone makes immigration status independent of the investment.

Residence and naturalization are separate. None of these investments grants automatic citizenship or a guaranteed passport date. See the citizenship eligibility comparison.
