Notary Public Services in Brazil: Guide for Foreigners

By Zachariah Zagol Attorney — OAB/SP 351.356

Quick Answer

What are notary services in Brazil? Brazilian cartórios are government-authorized offices that handle document authentication, signature certification, property registration, apostille issuance, and civil records. Brazil has over 13,000 cartórios regulated by state courts. Foreigners need a CPF and valid identification to use most services. Costs follow state-regulated fee tables. The e-Notariado platform enables remote digital notarization via video conference.

What Is a Cartório? Brazil vs US Notary Differences

A cartório in Brazil serves a fundamentally different function than a notary public in the United States. While US notaries primarily witness signatures — a service that costs $2-10 and requires minimal training — Brazilian cartórios are full-service legal institutions with broad governmental authority.

Brazilian notaries (tabeliães) must hold a law degree and pass a highly competitive public examination (concurso público). They are appointed for life by the state judiciary. Their legal authority includes:

  • Document authentication (autenticação de cópias)
  • Signature certification (reconhecimento de firma)
  • Property deed creation (escritura pública)
  • Marriage ceremonies and civil registrations
  • Apostille issuance under the Hague Convention
  • Sworn translations certification
  • Powers of attorney (procuração pública)

According to CNJ data, Brazil operates 13,482 cartórios across all 26 states plus the Federal District. São Paulo state alone has 2,847 cartórios — the highest concentration in the country.

Types of Cartórios

Tabelionato de NotasNotarization, deeds, powers of attorneyProperty purchases, legal representation
Registro de ImóveisProperty registrationReal estate transactions
Registro CivilBirths, deaths, marriagesMarriage registration, birth certificates
Registro de Títulos e DocumentosDocument registrationContract registration, notifications
Tabelionato de ProtestoProtest of unpaid debtsDebt collection proceedings

How Does Authentication (Reconhecimento de Firma) Work?

Reconhecimento de firma is the most common cartório service. It certifies that a signature on a document belongs to the person who claims to have signed it.

Two Types of Signature Authentication

  1. Reconhecimento por semelhança (by similarity): The cartório compares the signature against a registered signature card. The signer does not need to be present. Cost: R$15-20. Processing: immediate.

  2. Reconhecimento por autenticidade (by authenticity): The signer must appear in person at the cartório and sign the document in front of the notary. Cost: R$20-25. Processing: immediate.

Requirements for Foreigners

Foreigners must first open a signature card (ficha de assinatura) at the cartório. Requirements:

  • Valid passport or CRNM (Carteira de Registro Nacional Migratório)
  • CPF number
  • Proof of address in Brazil (comprovante de residência)
  • Payment of registration fee: R$15-30

Once registered, you can authenticate signatures at any branch of that cartório network.

What Is Apostille and How Does It Work in Brazil?

Brazil joined the Hague Apostille Convention on August 14, 2016. Before that, document legalization required consular processing — a multi-step process taking weeks.

Apostille Process

  1. Bring the original document to any cartório authorized for apostille services
  2. Pay the fee: R$133 (2026 regulated rate)
  3. The cartório issues an apostille certificate — either stamped on the document or attached as a separate page
  4. Processing time: 1-3 business days (same-day available at some cartórios)

Important Rules for Foreigners

  • Foreign documents destined for use in Brazil must first be apostilled in the country of origin, then translated by a sworn translator (tradutor juramentado) in Brazil
  • Brazilian documents destined for use abroad are apostilled at any Brazilian cartório
  • Academic documents (diplomas, transcripts) must be apostilled at the issuing institution’s state
  • Documents in languages other than Portuguese require sworn translation before apostille

What Is e-Notariado? Digital Notarization in Brazil

e-Notariado is Brazil’s digital notarization platform, created by Provimento CNJ 100/2020. It enables remote notarization without physically visiting a cartório.

How It Works

  1. Access e-notariado.org.br
  2. Create an account using gov.br (silver or gold level) or ICP-Brasil digital certificate
  3. Schedule a video conference with a registered notary
  4. Present identification during the video call
  5. Sign documents digitally using your certificate
  6. Receive digitally signed notarized documents

Available Services via e-Notariado

  • Powers of attorney (procuração pública)
  • Declarations and affidavits
  • Certain types of public deeds (escrituras)
  • Authorization for minors to travel

Limitations

  • Property transfer deeds (escritura de compra e venda) for values above 30x minimum wage still require in-person attendance at some states
  • Marriage ceremonies cannot be performed remotely
  • Requires ICP-Brasil digital certificate (e-CPF) or verified gov.br account
  • Not all cartórios participate — check availability in your city

What Documents Do Foreigners Most Commonly Need at Cartórios?

For Immigration

  • Authenticated passport copies — Required for visa applications, police registration, bank accounts
  • Apostilled foreign documents — Birth certificates, marriage certificates, criminal background checks
  • Sworn translations — All foreign documents must be translated by a tradutor juramentado

For Property Purchases

  • Escritura pública de compra e venda — The public deed of purchase and sale, mandatory for property transactions
  • Certidão de matrícula atualizada — Updated property registration certificate from Registro de Imóveis
  • Procuração pública — Power of attorney if purchasing through a representative

For Business

  • Reconhecimento de firma on corporate documents — Required for Junta Comercial filings
  • Authenticated copies of articles of incorporation — For bank accounts and government registrations
  • Procuração pública — Power of attorney for legal representatives

For Family Matters

  • Marriage certificate (certidão de casamento) — Required for spouse visa applications
  • Birth certificate registration — For children born in Brazil to foreign parents
  • Divorce documentation — Consensual divorce can be performed at cartório (Lei 11.441/2007)

Tips for Foreigners Using Brazilian Cartórios

  1. Bring a CPF — Required for virtually all services. Get one at Receita Federal or Brazilian consulate abroad.

  2. Hire a sworn translator — If you don’t speak Portuguese fluently, a tradutor juramentado must accompany you for signing public deeds. Find registered translators at your state’s Junta Comercial.

  3. Check operating hours — Most cartórios close by 17:00. Arrive before 16:00 for complex services.

  4. Bring originals — Cartórios require original documents for authentication. Copies of copies are not accepted.

  5. Budget for multiple visits — Complex transactions (property purchases, power of attorney) may require 2-3 visits over 1-2 weeks.

  6. Use e-Notariado when possible — Saves time for powers of attorney and simple declarations. Especially useful if you live outside major cities.

  7. Keep copies of everything — Cartórios issue numbered receipts (recibos). Keep these as proof of service.
